Not so sound rude, but this is a fansite that's all about Nintendo, so it comes with the territory. You can find fansites for just about any company that will do the same.

I don't defend everything nintendo does, for they did make bad mistakes during the GCN era... But in this case it isn't even a problem considering they are doing their job. And to be honest there are not really many "defend everything" fans out there, at least no more than any other fandom. It's the fact that he pretty much is very mad about it and refuses to accept he did use the footage without permission (Along with calling this comment section out and slight ranting on soundcloud, since on there he made a couple of good points) that makes his reaction not necessary at all.

Not Nintendo of Japan or somewhere else.
Nintendo of AMERICA.
Virtually ALL the recent bad press about Nintendo doing the most douche of things has been attributed to Nintendo of AMERICA.
These American corporate douchebags get on my frikin wick.
All they see is ways to make and protect their money and don't give a second thought to anything else that might be important to a company and it's business, like keeping customers, fans and supporters happy and encouraging the community etc, even when it some cases it might actually work out better for them in the long run to do so.
Totalbiscuit is a very reactionary person, but he usually pulls himself together 5 to 6 hours later depending on who actually is at fault.
For example, he clashed with Nintendo a few months back when an issue came with his daily news show, which turned out to be an Content ID issue that apparently got fixed by NoA.
Also, he bought the new Pokemon game, the first one he has played since gold and silver and was discussing about it on his podcast.
Also, depending if he showed the footage or not, he still gets paid via ad revenue, so I doubt he was 'cashing in'.

Which is such a great reason to ignore someone's misfortune.
Sorry, but... people are way too accepting of some of Nintendo's decisions recently. It's like the fans have been treated poorly by other gamers for so long they'll now just defend every single decision Nintendo makes regardless of whether it's any good.
First they came for the communists,
and I didn't speak out because I wasn't a communist.
Then they came for the socialists,
and I didn't speak out because I wasn't a socialist.
Then they came for the trade unionists,
and I didn't speak out because I wasn't a trade unionist.
Then they came for me,
and there was no one left to speak for me.
