After it finished reviewing all the evidence in the pre-trial lead up to its high-profile lawsuit against former Infinity Ward co-heads Jason West and Vince Zampella, Activision believed that the discovery phase didn't implicate the constituents of the so-called "Infinity Ward Employee Group," a source familiar with the case told Polygon. As a result, the video game publisher issued a check to the group's lawyers for $42 million dollars today, which includes 10 percent interest and is in addition to the original $22 million already paid for the promised first quarter launch bonus.

Why does it feel like Activision is getting brownie points whereas EA is losing them?

Yeah, while it's nice to see they (well, everyone except west and zampella, whose trial is still pending) got all the money they were legally and justifiably entitled to after all these years; it's still kind of sickening that they didn't get it unitl now, days before their trial, just so Activision gets brownie points and they have one less legal battle to deal with; not because it's the right the to do by law (and fairness, really, whatever that's worth).

Because EA noticed all the hate Activision was getting so they felt they could get away with a lot of things. EA pursued these tactis while Activision is making up for their mistakes and now EA is on the hate radar.

Pshh.... $42m is nothing to Activision. They bring in sooo much more than that every single month in WoW subscriptions alone (11 million subs x $15 per month). Not to mention, any software sales, etc... :-/
