Wii U, Nintendo Network ID and arbitration

Reader LexMetroid was doing some Wii U reading. He checked out the terms of service for Nintendo Network IDs and found some interesting information on arbitration. Here's what he found...

Section 10 of the Wii U Network Services Agreement states in part that "any matter we are unable to resolve and all disputes or claims arising out of or relating to this Agreement ... shall be finally settled by binding arbitration," meaning that a user may not sue Nintendo.

In addition, "any such arbitration shall be conducted by the parties in their individual capacities only and not as a class action or other representative action, and the parties waive their right to file a class action or seek relief on a class basis" means that users are unable to initiate a class-action lawsuit against Nintendo.

...one can opt-out of the arbitration provision of the agreement, if one sends written notice within 30 days: "You have the right to opt out of the provisions of this Section 10 by sending written notice of your decision to opt out to the following address: Nintendo of America Inc., Attn: CS Admin, 4600 150th Ave NE, Redmond, WA 98052 within 30 days of creating your Network Account."


Now you know what's up...and you actually still have time to send in your letter to Nintendo! If you plan on suing them in the future...or having the open option to, you'll need to mail in!
